Terms of Service - FitCheck

1. Acceptance of Terms

By installing or using FitCheck ("the Extension", "we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not install or use the Extension.

2. Description of Service

FitCheck is a Chrome extension that provides AI-powered virtual clothing try-on functionality. The Extension allows users to:

Create digital avatars by uploading full-body photos
Generate AI avatars from selfie photos with customizable body type
Virtually try on clothing items from any website by right-clicking on garment images
View before/after comparisons of try-on results
Save and manage try-on history in a personal Wardrobe
Download and share try-on results

3. User Accounts

3.1 Account Requirements

You must sign in with a valid Google account to use the Extension
You are responsible for maintaining the security of your Google account
You must notify us immediately of any unauthorized use of your account

3.2 Age Requirement

You must be at least 13 years old to use this Extension. By using the Extension, you represent and warrant that you meet this age requirement.

4. Acceptable Use

You agree NOT to:

Upload illegal, offensive, obscene, or inappropriate content
Upload images of other people without their explicit consent
Upload images that violate any third party's intellectual property rights
Use the Extension for any unlawful or fraudulent purpose
Attempt to reverse engineer, decompile, or disassemble the Extension
Use the Extension for commercial redistribution of generated content without permission
Circumvent any security features or access restrictions
Use automated systems, bots, or scripts to access the Extension
Interfere with or disrupt the Extension's functionality
Attempt to bypass AI safety filters or content policies

5. User Content

5.1 Ownership

You retain ownership of all photos and images you upload to the Extension, including avatars and selfies.

5.2 License Grant

By uploading content, you grant us a limited, non-exclusive, royalty-free license to:

Process your images for virtual try-on generation
Send your images to Google Gemini AI for processing
Store your content as necessary to provide the service
Display your content back to you within the Extension

5.3 Content Guidelines

Your uploaded content must:

Be photos you have the right to use
Not contain illegal or harmful content
Not violate any third party's rights

5.4 Content Removal

We reserve the right to remove any content that violates these Terms without prior notice.

6. AI-Generated Content

6.1 Nature of Results

Virtual try-on results are AI-generated approximations
Results may not perfectly represent how clothing will look in real life
Color, fit, texture, and appearance may vary from actual products
AI generation quality depends on avatar and garment image quality

6.2 No Guarantees

We do not guarantee the accuracy of virtual try-on results
Results should not be the sole basis for purchase decisions
We are not responsible for purchase decisions based on try-on results
Actual clothing may differ significantly from AI-generated previews

6.3 Ownership of Generated Content

You own the virtual try-on images generated using your avatar. You may download and share these images for personal, non-commercial use.

6.4 AI Safety

Our AI service includes safety filters. Content that violates Google's AI safety policies may be blocked. We are not responsible for content that is blocked by these safety measures.

7. Intellectual Property

7.1 Our Property

The FitCheck name, logo, and branding are our trademarks
The Extension code, design, and user interface are our proprietary software
All AI integration and processing logic are proprietary

7.2 Third-Party Content

Clothing images from websites remain the property of their respective owners
We do not claim ownership of any third-party content processed through the Extension
Use of third-party clothing images is subject to those parties' terms

7.3 No Affiliation

FitCheck is not affiliated with, endorsed by, or sponsored by any e-commerce store, clothing brand, or retailer. The Extension works independently of any specific website.

8. Disclaimers

8.1 "As Is" Service

THE EXTENSION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 Service Availability

We do not guarantee that the Extension will be available at all times
The Extension may experience downtime, errors, or interruptions
AI processing depends on third-party services (Google Gemini) and may be temporarily unavailable

8.3 Results Accuracy

We do not warrant the accuracy, completeness, or usefulness of any AI-generated content
Virtual try-on results are approximations and should be treated as such

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
We shall not be liable for any loss of profits, data, goodwill, or other intangible losses
We shall not be liable for any damages arising from your reliance on try-on results
Our total liability shall not exceed the amount you paid for the Extension (if any), or $10 USD, whichever is greater

10. Indemnification

You agree to indemnify, defend, and hold harmless FitCheck and its operators from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

Your use of the Extension
Your violation of these Terms
Your violation of any third-party rights
Content you upload to the Extension

11. Termination

11.1 By Us

We may terminate or suspend your access to the Extension at any time, without prior notice, for conduct that we believe:

Violates these Terms
Is harmful to other users, us, or third parties
Is otherwise objectionable or inappropriate

11.2 By You

You may stop using the Extension at any time by uninstalling it from Chrome.

11.3 Effect of Termination

Upon termination:

Your right to use the Extension ceases immediately
Your data will be handled according to our Privacy Policy
You may request deletion of your data by contacting us

12. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by updating the "Last Updated" date at the top of this document. Your continued use of the Extension after changes constitutes acceptance of the modified Terms.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FitCheck regarding the Extension.

13.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

13.5 Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
